June 4 (Reuters) – An appeals court in the U.S. state of Colorado on Thursday ordered a retrial of two paramedics \u200bconvicted over the death of Elijah McClain, a \u200cyoung Black man who was pinned down by police and injected with a powerful sedative.<\/div>\n
McClain, a 23-year-old massage therapist, was stopped \u200bby officers in Aurora, a Denver suburb, in \u200b2019 after a report of suspicious behavior. Officers \u2060placed him in a neck hold, and paramedics Jeremy \u200bCooper and Peter Cichuniec injected him with an excessive \u200bdose of ketamine. He later died.<\/div>\n
The case inspired police reforms in Colorado, including a ban on chokeholds.<\/div>\n
Cooper and Cichuniec were found guilty \u200bof criminally negligent homicide in 2023. The Colorado Court \u200bof Appeals reversed those convictions on Thursday, citing errors in the \u200cjury \u2060instructions, but upheld Cichuniec’s separate conviction for second-degree felony assault.<\/div>\n
Cooper was sentenced in 2024 to 14 months in a work-release program, and four years of probation.<\/div>\n
Cichuniec was released early from prison \u200bin 2024 \u200bafter a judge \u2060reduced his sentence to four years of probation.<\/div>\n
Attorneys representing McClain’s mother and the two \u200bparamedics did not immediately respond to requests \u200bfor \u2060comment.<\/div>\n
A jury came to a split verdict for three officers in the case.<\/div>\n
Randy Roedema was found guilty of criminally negligent homicide while Jason \u2060Rosenblatt was \u200bfound not guilty on manslaughter \u200band assault charges.<\/div>\n
Another police officer, Nathan Woodyard, was found not guilty of manslaughter.<\/div>\n<\/div>\n
